General Terms and Conditions

Article 1 – Definitions

In these general terms and conditions, the following definitions apply:

  • Withdrawal Period: the period during which the consumer may exercise their right of withdrawal;

  • Consumer: the natural person who is not acting in the exercise of a profession or business and who enters into a distance contract with the trader;

  • Day: calendar day;

  • Ongoing Transaction: a distance contract relating to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time;

  • Durable Data Carrier: any means that enables the consumer or trader to store information addressed personally to them in a way that allows future consultation and unchanged reproduction of the stored information;

  • Right of Withdrawal: the consumer’s option to withdraw from the distance contract within the withdrawal period;

  • Trader: the natural or legal person who offers products and/or services to consumers at a distance;

  • Distance Contract: a contract concluded within the framework of a system organized by the trader for the distance sale of products and/or services, whereby exclusive use is made of one or more means of distance communication up to and including the conclusion of the contract;

  • Means of Distance Communication: means that can be used to conclude a contract without the consumer and trader being present in the same place at the same time;

  • General Terms and Conditions: the present general terms and conditions of the trader.

Article 2 – Right of Withdrawal

The consumer has the right to withdraw from the contract within a cooling-off period of 14 days without giving any reason.

During the cooling-off period, the consumer shall handle the product and packaging with care. If the consumer exercises their right of withdrawal, they shall return the product with all delivered accessories and, where reasonably possible, in its original condition, in accordance with the reasonable instructions provided by the trader.

Article 3 – Applicability

These general terms and conditions apply to all offers made by the trader and to all distance contracts and orders concluded between the trader and the consumer.

Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated before the distance contract is concluded that the general terms and conditions can be inspected at the trader’s premises and will be sent free of charge upon request.

If the distance contract is concluded electronically, the text of these general terms and conditions may be made available electronically in such a way that the consumer can easily store them on a durable data carrier. If this is not reasonably possible, it will be indicated where the general terms and conditions can be accessed electronically and that they will be provided free of charge upon request.

If specific product or service conditions apply in addition to these general terms and conditions, the above provisions shall apply accordingly, and in the event of conflicting terms, the consumer may always rely on the provision most favorable to them.

If one or more provisions of these general terms and conditions are wholly or partially invalid or void at any time, the remaining provisions shall remain in force, and the invalid provision shall be replaced by a provision that most closely reflects the intent of the original.

Situations not regulated by these general terms and conditions shall be assessed “in the spirit” of these terms. Any ambiguities regarding interpretation shall likewise be interpreted in the spirit of these general terms and conditions.

Article 4 – The Offer

If an offer has a limited validity period or is subject to conditions, this shall be explicitly stated. All offers are non-binding. The trader reserves the right to modify and adjust offers.

The offer includes a complete and accurate description of the products and/or services offered. Images used are a truthful representation of the products and/or services. Obvious errors or mistakes do not bind the trader.

All images, specifications, and data are indicative and cannot be grounds for compensation or termination of the contract. The trader cannot guarantee that displayed colors exactly match actual product colors.

Each offer contains sufficient information to make clear the rights and obligations associated with acceptance of the offer, including but not limited to: delivery costs, the manner in which the contract is concluded, payment, delivery and execution methods, applicability of the right of withdrawal, price validity period, communication costs, contract archiving, correction of data, available languages, applicable codes of conduct, and minimum contract duration where applicable.

Optional: available sizes, colors, material types.

Article 5 – The Contract

The contract is concluded when the consumer accepts the offer and fulfills the stated conditions. Electronic acceptance is confirmed electronically without delay. Until confirmation is received, the consumer may dissolve the contract.

The trader shall take appropriate technical and organizational measures to secure electronic data transfer and ensure a safe web environment. Electronic payments shall be secured accordingly.

The trader may investigate the consumer’s ability to meet payment obligations and may refuse or condition an order with stated reasons.

Upon delivery, the trader shall provide the consumer with written or durable access to: contact details, withdrawal conditions, warranty information, contract details, and termination terms where applicable.

Each contract is concluded subject to the availability of the relevant products.

Article 6 – Right of Withdrawal

The consumer may withdraw from a product purchase within 14 days from the day after receipt.

During this period, the consumer shall only use the product as necessary to assess it. Upon withdrawal, the product must be returned with all accessories and, where reasonably possible, in original condition and packaging.

The consumer must notify the trader within 14 days and return the product within 14 days thereafter, providing proof of timely return. Failure to do so finalizes the purchase.

Article 7 – Costs in Case of Withdrawal

If the consumer exercises the right of withdrawal, the return shipping costs are borne by the consumer.

Any paid amounts shall be refunded as soon as possible, but no later than 14 days, provided the product has been received or return proof has been supplied.

Article 8 – Exclusion of the Right of Withdrawal

The trader may exclude the right of withdrawal for products or services clearly stated in advance, including but not limited to:

  • custom-made or personalized products;

  • perishable goods;

  • sealed hygiene products once unsealed;

  • newspapers, magazines;

  • unsealed audio/video recordings or software;

  • services performed with prior consent;

  • accommodation, transport, leisure services on specific dates;

  • betting and lottery services.

Article 9 – Price

Prices remain unchanged during the stated validity period, except for VAT changes or legally required adjustments.

Price increases within 3 months are only permitted by law; beyond 3 months only if stipulated and the consumer may terminate the contract.

All prices are subject to typographical errors. The trader is not obliged to honor incorrect prices.

Article 10 – Conformity and Warranty

Products and services conform to the agreement, specifications, and legal requirements. Warranties do not affect statutory consumer rights.

Defects must be reported within 14 days of delivery. Warranty excludes misuse, unauthorized repairs, or abnormal conditions.

Article 11 – Delivery and Execution

Orders are executed with due care and delivered within 30 days, unless otherwise agreed. Delays or partial delivery entitle the consumer to terminate the contract and receive a refund within 14 days.

Risk passes to the consumer upon delivery unless otherwise agreed.

Article 12 – Ongoing Transactions: Termination and Renewal

Indefinite contracts may be terminated at any time with up to one month’s notice.

Fixed-term contracts may not be automatically renewed, except limited newspaper subscriptions. Contracts longer than one year may be terminated after one year with one month’s notice.

Article 13 – Payment

Unless otherwise agreed, payment is due within 7 working days. Errors in payment details must be reported immediately. Reasonable collection costs may be charged.

Article 14 – Complaints Procedure

Complaints must be submitted within 7 days of discovery and will be responded to within 14 days. Unresolved complaints may lead to dispute resolution procedures.

Article 15 – Disputes

All agreements are governed exclusively by Dutch law, even if the consumer resides abroad.
